Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your use of Flumen Studio software and the website at getflumen.com, operated by MediaCODE d.o.o. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

2. Definitions

• "Service" - refers to the Flumen Studio desktop application and the website at getflumen.com.
• "User" or "You" - refers to any person who accesses or uses the Service.
• "We", "Company" - refers to MediaCODE d.o.o., Lepusici 75, 10040 Zagreb, Croatia (VAT: HR02253992940).

3. Account

To use certain features of the Service, you must create an account. By creating an account, you agree to the following:

• You must be at least 16 years old to create an account.
• You are responsible for maintaining the security of your account credentials and for all activities that occur under your account.
• Only one account per person is allowed.
• You must provide accurate and complete information when creating your account and keep it up to date.

4. Free Trial

We offer a 14-day free trial with full access to all features of Flumen Studio. The trial period begins on the date of account creation. No credit card is required to start the trial. After the trial period ends, a paid subscription is required to continue using the Service.

5. Subscription & Payment

Flumen Studio is available through the following subscription plans:

• Monthly plan - EUR 10 per month.
• Yearly plan - EUR 100 per year.

All payments are processed securely by Stripe. Subscriptions automatically renew at the end of each billing period unless canceled. You may cancel your subscription at any time, and you will retain access until the end of the current billing period. No refunds are provided for partial billing periods. We reserve the right to change pricing with at least 30 days prior notice.

6. License

Subject to your compliance with these Terms and a valid subscription, we grant you a limited, non-exclusive, non-transferable, revocable license to use Flumen Studio for your personal use. This license is strictly personal. You may not resell, sublicense, redistribute, or otherwise make the software available to any third party.

7. Your Content

You retain full ownership of any content you create using Flumen Studio, including videos, overlays, and projects. We do not claim any ownership rights over your content. Content you choose to share in the community is shared under your own terms and at your own discretion. We reserve the right to remove any community content that violates these Terms.

8. Acceptable Use

When using the Service, you agree not to:

• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the software.
• Use the Service for any illegal or unauthorized purpose.
• Attempt to bypass, disable, or circumvent any subscription or license checks.
• Abuse, overload, or interfere with the API or Service.

9. Intellectual Property

The Flumen Studio software, website, branding, logos, and all related materials are the intellectual property of MediaCODE d.o.o. and are protected by applicable copyright and trademark laws. Community overlays and user-created content remain the property of their respective creators.

10. Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. To the fullest extent permitted by law, MediaCODE d.o.o. shall not be liable for any data loss, lost profits, business interruption, or any indirect, incidental, special, or consequential damages arising from your use of the Service. Our maximum aggregate liability is limited to the total amount you have paid to us in the 12 months preceding the event giving rise to the claim.

11. Termination

You may delete your account at any time through your account settings. We reserve the right to suspend or terminate accounts that violate these Terms. Upon termination, your personal data will be deleted within 30 days in accordance with our Privacy Policy.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Croatia. Any disputes arising from or related to these Terms shall be resolved exclusively in the courts of Zagreb, Croatia.

13. Changes to These Terms

We reserve the right to update or modify these Terms at any time. Continued use of the Service after any changes constitutes your acceptance of the updated Terms. Material changes will be communicated to you at least 30 days in advance via email or through the Service.
